House Republicans just won a major, unexpected victory in a battle with Obama……

Republicans in the US House of Representatives have standing to proceed with a lawsuit against US President Barack Obama’s administration over his signature healthcare law, a federal judge said Wednesday, handing them a significant and somewhat unexpected victory in the ongoing legal battle.

US District Court Judge Rosemary M. Collyer ruled Wednesday against the Obama administration’s motion to dismiss the case. Collyer said House Republicans do have the standing to pursue their challenge, which argues that the Obama administration violated the US Constitution by spending money on the law that had not been appropriated by Congress.

That was a key question in the lawsuit, which the White House and House Democrats have continually dismissed as a “political stunt.”

In her ruling, Collyer rejected that argument, calling the House’s challenge valid.

“Despite its potential political ramifications, this suit remains a plain dispute over a constitutional command, of which the Judiciary has long been the ultimate interpreter,” she wrote.

The case centers on the more than $175 billion the administration will spend over the next decade under a cost-sharing program with health-insurance companies. The Obama administration has said it’s spending previously allocated money.

The attorney for the House, Jonathan Turley, called Collyer’s decision “historic and profound.”

“The ruling today means that the United States House of Representatives now will be heard on an issue that drives to the very heart of our constitutional system: the control of the legislative branch over the power of the purse,” he wrote in a statement posted to his website. “We are eager to present the House’s merits arguments to the Court and remain confident that our position will ultimately prevail in establishing the unconstitutional conduct alleged in this lawsuit.”

House Speaker John Boehner (R-Ohio), who’s leading the lawsuit against the president, said he was “grateful” for the court’s ruling.

“The president’s unilateral change to Obamacare was unprecedented and outside the powers granted to his office under our Constitution,” Boehner said in a statement. “I am grateful to the court for ruling that this historic overreach can be challenged by the coequal branch of government with the sole power to create or change the law. The House will continue our effort to ensure the separation of powers in our democratic system remains clear, as the Framers intended.”

Federal Judge O’Connor to rule against Obama on Illegal Aliens…or as Judge Judy would say “Whack his pee-pee”


A federal judge has a message for President Obama: Stop bypassing Congress on immigration.

Obama issued a directive in June 2012 halting the deportation of many young illegal aliens after Congress refused to pass the DREAM Act, which would have provided conditional permanent residency to young illegals.

A federal judge in Dallas is now threatening to reverse that directive.

U.S. District Judge Reed O’Connor said Tuesday that he will likely rule in favor of a lawsuit seeking to overturn the new policy. He has asked both sides to file additional arguments by May 6.

The administration’s policy directs U.S. Immigration and Customs, or ICE, agents to defer deportation for illegal aliens under 30 who entered the country before the age of 16, are in school or have a high school diploma, haven’t been convicted of a felony, significant misdemeanor or multiple misdemeanors and are not a threat to public safety or national security.

The ICE agent union challenged the policy, arguing that the Obama administration is disciplining agents who enforce federal immigration law.

The president of that union, the National Immigration and Customs Enforcement Council, also said the policy is being abused.

In his April 8 testimony, Christopher L. Crane said, “Officers are applying the directive to people detained in jails, not kids in school.”

He told the court, “It is now the story in the jails for aliens to use to avoid arrest and deportation.”

Those aliens appear to be taking advantage of the policy with great success. National Review found, “Since the policy took effect in August 2012, the Obama administration has approved 268,361 applications for ‘deferred action’ status, and denied just 1,377 – an approval rate of 99.5 percent.”

While critics argue the policy is ineffective in securing the border, Judge O’Connor indicated it’s also illegal for the Obama administration to tell immigration agents not to arrest an illegal alien who is a low priority.

“The court finds that DHS (Department of Homeland Security) does not have discretion to refuse to initiate removal proceedings,” Judge O’Connor wrote.

O’Connor issued a court order stating that Congress, not the president, sets priorities for arresting illegal aliens and that the law requires them to face deportation.

President Obama, congressional Democrats and even some Republicans plan to push new gun-control legislation in the 113th Congress, but defenders of the Second Amendment fear Obama is poised to enact the restrictions through the Executive Branch if Congress is not cooperative.

John M. Snyder heads GunRightsPolicies.org and has worked for organizations from the National Rifle Association to the Second Amendment Foundation and the Citizens Committee for the Right to Keep and Bear Arms. He said Obama and his allies have already chartered what regulatory course to pursue through the Bureau of Alcohol, Tobacco, Firearms and Explosives, or ATF.

“We have some confidential information that he may order the ATF to reclassify certain models of semi-automatic firearms as Title 2 guns under the Gun Control Act of 1968,” Snyder told WND. “What this would mean is that people could not obtain these without going through a terribly difficult process that includes registration of each firearm and paying a severe fee for the ownership of each one.”

Snyder said an even more drastic approach from Obama would be to try to ban semiautomatic weapons altogether.

“Also, there is the possibility that the administration could try to declare that semi-automatic firearms are fully automatic firearms or machine guns under this Title 2, in which case they would be banned because of an amendment that’s on the books, the Gun Control Act of 1968.

Snyder is referring to what’s known as the Hughes Amendment, which forbids the acquisition of any new fully automatic weapons or machine guns.

The possible strategy is not a new idea, according to Snyder. He said liberal groups have advocated the move for years, but Democrats have been reluctant to pursue it because of the massive public backlash that will ensue.

“This is an ongoing project of theirs, and they use a lot of these tragedies to try to advance their cause in a public relations sense. So far they’ve been unable to do that,” said Snyder. “It appears that the public is catching on to them and they know what their game plan is, generally speaking. So a lot depends on their frustration, the political situation at the time and a number of other factors, too.”

Even if the Obama administration were to bypass Congress by imposing new regulations, there is still one card left for pro-Second Amendment forces to play: The House of Representatives could remove funding for the ATF or abolish it completely. But would the House GOP actually do that? Snyder is confident it would.

“I wouldn’t be surprised. I think the House is really furious with the president,” Snyder said. “The Republicans would like to cut budgets of the federal government because they think the federal government is taking too much money and spending too much money, and a good place for them to cut would be in the Bureau of Alcohol, Tobacco and Firearms. If there is strong enough public support against the activities of the federal government, the House of Representatives will develop a plan to slash the budget of the agency. I think it’s a real possibility.”

Sheriff Arpaio: I’ll Continue Enforcing Immigration Law


Arizona Sheriff Joe Arpaio will continue to enforce the state’s immigration laws despite the compassion he feels for young illegal immigrants who seek work and education, he told Newsmax.TV in an exclusive interview.

Gov. Jan Brewer last week ordered state agencies to deny driver’s licenses and public benefits to anyone protected from deportation under President Barack Obama’s “deferred action” immigration policy.

Arpaio — sheriff of Maricopa County, which includes Phoenix — called Brewer’s executive order a “very complex, very controversial” move.
“I do have compassion for the young people that want an education,” he said. “On the other hand, I took an oath of office to enforce all the laws and now that overrides my compassion. So we have to enforce the laws…We have to enforce those illegal-immigration laws regardless of what the issue is.”

Over a Million Illegals Poised to Come Out of Shadows


Some 1.7 million young illegal immigrants are poised to come out of the shadows and live and work openly in the United States as a result of a sweeping executive order signed by President Barack Obama. On Wednesday immigration officials will begin accepting applications to defer deportations, The New York Times reported.

Obama’s executive order sidestepped Congress that failed to pass the Dream Act and was a major peace offering to the Hispanic voters after the administration deported 1.2 million illegals in the last three years. The order grants two-year deportation deferrals, work permits and other benefits such as a driver’s license and Social Security number to illegals brought to the United States as children, the Times reported.

Immigration rights groups have been swamped with requests for information on the program and government officials are expecting the biggest jump in paperwork since three million immigrants applied for legal status under a 1986 amnesty.

The Migration Policy Institute estimates that about 1.2 million people are eligible to apply now, with another 500,000 reaching the minimum eligibility age of 15 in coming years, the Times reported. The largest number of eligible applicants is in California, Florida, New York and Texas.

The order does not give legal status or a path to citizenship and those applying must be in school, be high school graduate or have served honorably in the military. Those with criminal records will be rejected, the Times reported.

Cyber security bill was defeated in Congress …Obama eyes executive order.

Obama shows complete contempt for the Congress and what it stands for….

The beauty of living in the US is that we are able to elect representatives to Congress in order to carry out the will of the people.  The President is ordered by the Constitution in Article II to carry out the laws made by the Congress.  Thus, the President of the United States is a servant of We the People.  The Obama administration, however, seems to have trouble understanding his duties.

Recently, the Congress killed a ‘cyber security bill’.  The reasoning was that the US government would only over-regulate businesses, while costing the government money it doesn’t have, only to receive very little effectiveness in return.  Many also feared that it would open up the floodgates for the NSA to keep track of the law-abiding, everyday American’s online usage …as if it is any of their business in the first place.

However, this presidential administration has shown us on more than one occasion that when Obama wants to do something, but the people oppose it, the president simply does it anyway.  And so, President Obama may see fit to issue an executive order, again, bypassing the will of our elected Congress.
